FLORIDA – A Johnstown motorist was charged with vehicle assault and DWI following a serious injury crash on the Thruway in Florida City on Friday.
State Police reported that shortly before 11 a.m. Friday, soldiers responded to a serious accident on I-90, heading west of the city.
A preliminary investigation determined that Nicholas M. Moulton, 26, of Johnstown, was driving a 2018 Ford F350 westbound near mile 169.8 when he lost the rear tire on the driver’s side of his vehicle.
Soldiers said the tire passed through oncoming traffic and struck the hood and windshield of a 2014 Ford Focus.
Ford Focus front seat passenger – Susan J. Sady, 67, of Utica – was rushed to Albany Medical Center for non-life threatening injuries. The driver – Dariusz M. Sady, 68, from Utica – was taken by ambulance to Mount Carmel Church in Amsterdam, from where he was then airlifted to Albany Medical Center by Life Net for injuries serious.
A press release issued on Monday said Sady is currently listed in critical but stable condition.
As the soldiers continued the investigation and questioned Moulton, it was determined he was allegedly intoxicated, state police said. He was taken into custody and transported to SP Fultonville, where his blood alcohol level was determined to be 0.08%.
Moulton was charged with Second Degree Ram Car Assault, a Class E felony; and driving while intoxicated; an unranked misdemeanor. He was turned over to a sober third party and issued returnable appearance tickets in Florida City Court at 4 p.m. on June 24.
The soldiers said Moulton was not injured as a result of the crash.
